ORDER

The prayer in this writ petition is to issue a Writ of Mandamus, directing the respondents 1 to 5 complete the enquiry based on the petitioner's complaints dated 06.05.2025 and 27.06.2025 within a time as fixed by this Court and to take appropriate action against the 6th respondent. 2.

Learned counsel appearing for the petitioner would submit that the petitioner is the Managing Trustee of Shri Sundara Vinayagar Temple, Panagudi Village, Radhapuram Taluk, Tirunelveli District. The 6th respondent has trespassed into the 2/6

said temple land and illegally excavating the soil and committed the theft of red soil worth of several lakhs of rupees. Apart from that, the 6th respondent is also running a Bricklin illegally. When the petitioner attempted to put up fence, the 6th respondent criminally intimidated the petitioner and threatened the workers. Hence, the petitioner made a police complaint dated 06.05.2025 to the 5th respondent and another complaint dated 27.06.2025 to the respondents 1 to 3. Finding inaction on the part of the official respondents, the petitioner has filed this writ petition. 3.

Today, when the matter is taken up for hearing, learned counsel appearing for the petitioner would submit that it is suffice if the respondents 2 and 4 are directed to complete the enquiry on the petitioner's complaints dated 06.05.2025 and 27.06.2025 within a time frame.

The learned Additional Government Pleader appearing for the respondents 1 to 4 would submit that enquiry proceedings 3/6

would be completed by the respondents 2 and 4 on the petitioner's complaints dated 06.05.2025 and 27.06.2025 within a time frame to be fixed by this Court.

Recording the above submissions, the Writ Petition is disposed of directing the respondents 2 and 4 to conclude the enquiry proceedings on the petitioner's complaints dated 06.05.2025 and 27.06.2025 within a period of twelve weeks from the date of receipt of a copy of this order. During enquiry, if ultimately the respondents 2 and 4 found any illegal excavation of soil by the 6th respondent and running of illegal Bricklin by him, then appropriate action shall be taken against the 6th respondent in accordance with law. No costs. Consequently, connected miscellaneous petition is closed.
