Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to calling for the records relating to the petitioner's Bill in Impugned Bill No.112024192 dated 03.12.2024 issued by the second respondent in so far as 'Outstanding Due' is concerned and quash the same and further directing the second respondent to issue future bills without insisting for any such demand.

O R D E R

This writ petition has been filed challenging the Impugned Bill No.112024192, dated 03.12.2024 issued by the second respondent in so far as 'Outstanding Due' is concerned.

2. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

4. Though the writ petition is filed challenging the bill dated 03.12.2024 thereby call upon the petitioner to pay the outstanding due to the tune of Rs.13,60,578/- the petitioner restricted his prayer to the extend that after the bill, the petitioner submitted a detailed representation and it may be considered after conducting an enquiry.

In view of the above, the second respondent is directed to conduct an enquiry on the representation submitted by the petitioner and pass orders on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order after giving an opportunity of hearing to the petitioner. Till then, the second respondent is directed not to precipitate the bill for execution.
