Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 147, 170 and 364(A) IPC in Cr.No.342 of 2018 on the file of the respondent police, seeks anticipatory bail.

2.It is the case of the prosecution that on 03.12.2018 at about 11.30 p.m., the petitioner and others calling themselves as Madukoor Police have taken the defacto complainant's son with them for enquiry. Thereafter, on 04.12.2018 they have demanded a sum of Rs.8,00,000/- over phone. Therefore, the Law Enforcing Agency has registered the case.

3.The learned counsel appearing for the petitioner would submit that the petitioner did not commit any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl.Side) appearing for the respondent State would submit that the first accused in this case has already been arrested and remanded in judicial custody and the kidnapped person / son of the defacto complainant has also been rescued and the other accused persons are absconding. Hence, he vehemently opposed to grant anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

5.Considering the facts and circumstances of the case and considering the serious offence levelled against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
