ORDER

The present writ petition has been filed seeking a mandamus directing the respondents to consider the representation of the petitioner dated 12.12.2025 wherein the petitioner has sought to cancel the legal heir certificate issued by the second respondent on 25.03.2010.

2. According to the learned counsel appearing for the writ petitioner, she is the daughter of deceased Muthusamy Pillai through his first wife, namely, Dhanalakshmi. Without incorporating her name, the children of the second wife had obtained legal heir certificate from the second respondent on 25.03.2010 and challenging the same, she has given a request to the first respondent on 12.12.2025. Since the same has not been disposed of, the present writ petition has been filed.

3. Considering the allegations made in the affidavit, it is clear that there is a dispute whether the legal heirs shown in the legal heir certificate are born through a valid marriage or not. This issue can be decided only by the competent civil Court. Considering the fact that the legal heir certificate was issued 15 years back, this Court is not inclined to entertain the present writ 2/4

petition.

4. It is open to the petitioner to approach the competent civil Court to establish her status as well as her property rights. 5.With the above said observations, this writ petition stands disposed of. No costs.
