No.1316 of 2023:- Criminal Miscellaneous Petition filed Under Section 482 of the Criminal Procedure, 1973 to pass an order of relaxation to relax the condition imposed on the petitioner vide order dated 23.12.2022 made in Crl.A.(MD)No.876 of 2022 on the file of this Honble High Court and thus render justice.

Prayer in Crl.A.(MD)No.876 of 2022:- This Criminal Appeal has been filed under Section 14(A)(2) SC/ST (POA) Act, to call for the records relating to the impugned order dated 09.12.2022 made in Cr.M.P.No.1149 of 2022 on the file of the learned Sessions Judge, Special Court for Trial of Cases registered under SC/ST (PoA) Act, 1989, Ramanathapuram, and to set aside the same and consequently to release the appellant on bail in connection with the FIR in Crime No.246 of 2022 on the file of the second respondent Police.

ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s. M.S. Jeyakarthik, Advocate for the Petitioner and of Mr. M. Sakthi Kumar, Government Advocate for the 1st and 2nd respondents, this Court made the following order:

This petition has been filed to relax the condition imposed on the petitioner in Crl.A.(MD).No.876 of 2022 on 23.12.2022.

2. The learned counsel for the petitioner submitted that the petitioner has been complying with the condition regularly and he prayed for relaxation of the said condition.

CRL MP(MD). No.1316 of 2023 3.The learned Government Advocate (Crl. side) submitted that investigation has been completed and final report was filed before the concerned Special Court on 10.01.2023, but the same was not taken cognizance.

4.Since the final report has been filed before the concerned Special Court, the condition imposed by this court in Crl.A.(MD). No.876 of 2022 on 23.12.2022 is relaxed and the petitioner shall report before the concerned Court for every hearing.
