O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to fourth respondents to amend the fraudulent FMB sketch maintained in the records of the fourth respondent Panchayat, in respect of the petitioner's land measuring 2 Acres and 571⁄2 Cents, comprised in Old S.No.96/2, New S.No.96/2B, New S.No.96/2A and S.No.96/1, situated at Idayapatti Village, Iluppoor Taluk, Pudukkottai District, as per the Settlement Deed vide Document No.1842 of 2024 on the file of the Iluppoor Sub-Registrar Office, based on the petitioner's representation dated 30.12.2025.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the fifth respondent, as no adverse orders are proposed to be passed against her.

The grievance of the petitioner is that the petitioner's aforesaid land and the land of the fifth respondent are adjacent to each other and originally shared an equal proportionate extent abutting the Highways Road. However, the fifth respondent, by colluding with the authorities, has caused a fraudulent FMB sketch to be prepared, depicting the petitioner's property as lying behind the land of the fifth respondent, thereby diminishing the market value of the petitioner's property and correspondingly enhancing the value of the fifth respondent's property.

Therefore, the petitioner submitted a representation dated 30.12.2025 to the first to fourth respondents seeking amendment of the fraudulent FMB sketch maintained in the records of the fourth respondent Panchayat, in respect of the petitioner's land, in accordance with the Settlement Deed dated 01.08.2024. However, no action has been taken on Page No. 3 of 6

the said representation. Hence, the petitioner has been constrained to file the present Writ Petition.

5. The learned Additional Government Pleader appearing for the first to fourth respondents, on instructions, would submit that the petitioner's representation dated 30.12.2025 would be considered and appropriate orders would be passed within a period of sixteen weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 30.01.2025 and pass appropriate orders on merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The said representation shall be disposed of after conducting an enquiry. The third respondent is also directed to afford a reasonable opportunity of hearing to the petitioner, the fifth respondent and any other interested parties who may be affected by such decision, before passing any order. It is needless to state that before passing any order, a survey shall be conducted through the Survey Wing and verification shall be carried out by the Firka Surveyor for correction of the Page No. 4 of 6

FMB. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs. Consequently, the connected Miscellaneous Petitions are closed.
