Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents to pay the petitioner's 60 days of earned leave salary, provident fund arrears, security deposit and other monetary benefits with 8.5% interest with the time stipulated by this Hon'ble Court based on the petitioner's representation dated 04.11.2024. ORDER
The instant writ petition has been filed by a retired supervisor of the 4th respondent Co-operative Primary Agricultural and Rural Development Bank Ltd., seeking a mandamus against the respondents to pay the petitioner's 60 days of earned leave salary, provident fund arrears, security deposit and other monetary benefits with 8.5% interest.
2. According to the learned counsel for the petitioner, the petitioner has attained superannuation as Supervisor on 31.05.2006, but so far the above said benefits have not been disbursed to him. Hence the petitioner has sent various representations and the final representation was sent on 04.11.2024. Even thereafter, no orders were passed. 2/4
3. The learned counsel appearing for the petitioner relies upon the similar order passed by this Court in W.P.(MD)No.1913 of 2021 dated 04.02.2022 filed by another employee namely Thangavel, wherein this Court has directed the societies to consider the representation and pass orders.
4. In view of the above said facts, the 4th respondent is directed to consider the representation of the petitioner dated 04.11.2024 and pass appropriate orders on merits and in accordance with law within a period of 8 weeks from the date of receipt of a copy of this order. 24.01.2025 NCC :yes/No Index :yes/No Internet:yes/No rgm 3/4
