(Crime No.303 of 2012) : Respondents/Respondents PRAYER: Petition is filed under Section 482 of the Criminal Procedure Code praying to direct the Inspector of Police, Aalanganallur Police Station,Madurai, Madurai District, the second respondent to investigate the case in Crime No.303 of 2012 pending on the file of the second respondent and further direct him to file a final report within the stipulated period as prescribed by this Court. ORDER

The petitioner has come forward with this petition under Section 482 of Code of Criminal Procedure, seeking a direction to the second respondent to investigate the case in Crime No.303 of 2012 and to file a final report within a stipulated time.

2. Heard the submissions made by the learned counsel appearing on either side.

3. The learned counsel for the petitioner would submit that on the basis of the complaint given by the petitioner, a case has been registered in Crime No.303 of 2012 on 07.12.2012 for the offences punishable under Sections 120(B), 420, 465, 468 of IPC. However, the second respondent has not shown any interest to investigate the matter and lay a final report. Hence, the petitioner has come up with the present petition for the relief as stated above. https://hcservices.ecourts.gov.in/hcservices/

4. Resisting the same, the learned Government Advocate (Crl.side) would submit that originally the case was registered in Kudalpudur police

station and subsequently, it was transferred to Alanganallur police station and investigation is going on and hence, he prays for three months time to complete the investigation and file a final report.

5. Considering the submissions made on both sides and also considering the fact that the case in Crime No.303 of 2012 was originally registered on the file of Kudalpudur Police Station and subsequently, it was transferred to Aalanganallur Police Station, this Court is inclined to grant three months time to the second respondent to complete the investigation and file a final report.

6. Accordingly, the second respondent is directed to complete the investigation in Crime No.303 of 2012 and file a final report, within a period of three months from the date of receipt of copy of this order.

7. The Criminal Original Petition is disposed of with the above direction.
