ORDER
The present Writ Petition Criminal has been filed seeking issuance of a Writ of Mandamus directing the respondents to provide adequate police protection for effecting electricity service connection to the petitioner's property.
2. The brief facts of the case are that the petitioner's mother and the fourth respondent's grandmother had purchased the subject property. At present, a dispute has arisen between the parties. It is brought to the notice of this Court that the fourth respondent has already filed a suit for recovery of possession. The very prayer in the said suit indicates that the petitioner is presently in possession of the property. Electricity service connection can be granted to a person who is in possession of the 2/5
property. Supply of electricity is an essential service. Therefore, the petitioner is entitled to seek electricity connection. However, such grant of electricity connection shall be subject to the outcome of the pending civil suit, and the petitioner shall enjoy the same until the rights of the parties are finally adjudicated therein.
3. The learned counsel appearing for the fourth respondent submitted that the petitioner ought to submit a fresh application. The petitioner, however, submitted that an application has already been submitted along with an indemnity bond to the third respondent.
4. In view of the above, the third respondent is directed to process the petitioner's application and provide electricity service connection, if the petitioner otherwise satisfies the statutory requirements. If any law and order issue arises, the respondent police shall provide necessary police protection, subject to payment of necessary charges. It is also made clear that the fourth respondent is stated to be in partial possession of the property, and the grant of electricity connection shall not confer any additional right or equity upon the petitioner. parties shall be independently adjudicated by the parties.
