2.The impugned communication issued by the jurisdictional Block Development Officer is only recommendatory in nature. The second respondent cannot take any coercive action on his own. As and when the first respondent initiates action based on the recommendation of the second respondent, all the defences of the petitioner can be projected. 3.This Writ Petition is disposed of accordingly. No costs.
