This Writ Petition has been filed seeking to direct the respondents to consider the petitioner's representation dated 01.09.2025 to produce the encumbrance certificate for the properties comprised at revenue village of Ilamanur, Melakottai, Madakottan, Pullankudi, Kannanrenthal, Thanushkodi, Perunkalur, Ramanathapuram district for the period from 28.07.1947 to 28.01.1951 encumbered by one late Kuppusamy Servai. 2.With the consent of the parties, the Writ Petition is taken up for final disposal at the admission stage itself. 2/6
3.The learned Counsel for the petitioner would submit that the petitioner had approached the respondents for production of encumbrance certificate for the aforementioned properties. In this regard, the petitioner has already given a representation to the respondents on 01.09.2025 . Since the said representation remains unconsidered, the petitioner has come up with the present Writ Petition.
4.Learned Additional Government Pleader appearing for the respondents would submit that the petitioner has sought for encumbrance certificate for 82 properties without providing the relevant survey numbers. Once the survey numbers are provided by the petitioner, necessary encumbrance certificates will be provided by the respondents. Without the survey numbers, the respondents are not in a position to provide the encumbrance certificates. 5.Accordingly, this Writ Petition is disposed of, by directing the petitioner to apply for the encumbrance certificates afresh, properly mentioning the relevant survey numbers and by remitting the appropriate fees. Upon such representation, the respondents 3/6
are directed to consider the same as expeditiously as possible. There shall be no order as to costs.
