ORDER
This petition is filed to condone the delay of 98 days in representation the above appeal.
2. Heard the learned counsel for the petitioner/appellant and the first respondent. The learned counsel for the first respondent has serious objection in allowing this petition.
3. Being satisfied with the reasons stated in the affidavit filed in support of this 1/3
petition, this petition is allowed on a condition that the appellant to deposit 60% of the award amount with proportionate interest to the credit of M.C.O.P.No.1081 of 2021 on the file of the Motor Accidents Claims Tribunal, Special District Judge, Madurai, within a period of seven (7) days from the date of receipt of a copy of this order. Failing which, this petition shall stand automatically dismissed without any further reference to this Court.
4. The claimants are permitted to withdraw the said amount, as per the apportionment made by the Tribunal by filing necessary application before the Tribunal.
