Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 420 IPC and Section 4 of Women Harassment Act and 506(i) IPC in Crime No.397 of 2014 on the file of the respondent police, seeks anticipatory bail.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. Earlier, this matter was sent to the Mediation Centre for bringing about settlement between the parties. Mediation Centre has sent a failure report dated 17.12.2014. On 27.01.2015, there was no representation for the petitioner. The Investigating Officer was present. Hence, this Court posted the matter to today finally.

4. Today, when the matter was taken up for hearing, learned counsel for the petitioner submits that his client has not given him proper instruction. Police is present. This Court perused the case diary and found that the defacto complainant in this case completed her M.Sc., B.Ed.,and that this petitioner promised her that he will get her a job as Revenue Inspector, representing that he has influence with some senior politicians in power. On the basis of the said representation, he has collected Rs.20,000/- on 02.11.2013 and Rs.1,00,000/- on 04.11.2013 as advance from the defacto complainant. Thereafore, he has neither got a job nor returned the amount thereby cheated her.

5. Taking into consideration the serious nature of allegation, this Court is not inclined to grant anticipatory bail to this petitioner.
