ORDER : The Court made the following order :- The petitioner / Accused who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 311 of BNS, in Crime No.499 of 2025 on the file of the respondent police, seeks anticipatory bail,

2. The prosecution case is that the petitioner along with other accused persons had waylaid the defacto complainant and abused in filthy language and attacked him and also criminally intimidated him. Further, the petitioner along with other accused persons had robbed a sum of Rs.1,300/-and also OPPO phone from the defacto complainant. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks anticipatory bail. 2/5

4. The learned Additional Public Prosecutor submitted that there are 8 previous cases pending against the petitioner and the investigation is still pending. He further submitted that the petitioner has involved in very serious offence. Hence, he strongly objected to the grant of anticipatory bail to the petitioner.

5. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and there are 8 previous cases pending against the petitioner. Further, if the petitioner is released on anticipatory bail, he may abscond. Hence this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

6. Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 20.01.2026 msrm 3/5
