Respondent PRAYER: Suo Motu Petition filed under Section 15 of the Contempt of Courts Act, 1971 r/w Article 215 of Constitution of India, praying this Court to initiate contempt proceedings against the contemnor / respondent and punish him for his deliberate attempt to scandalize and to lower the authority of the High Court by making unsubstantiated, frivolous allegations and casting aspersions against one of the Hon'ble Judges in the name of caste by his letter dated 19.07.2023 and 22.07.2023.

ORDER

[Order of the Court was made by D.KRISHNAKUMAR, J.] Today, when the matter is taken up for hearing, the respondent / partyin-person appeared before this Court and filed an affidavit for withdrawing the allegations made against one of the Hon'ble Judges of this Court. The relevant portion of the affidavit is extracted hereunder:- "3........Therefore, I sent complaint as against the Hon'ble Mr.Justice S.S.SUNDAR,J, now, I analysed my mistake and I submit unconditional apology before this Hon'ble Court for the act of lodged complaints dated 16.07.2023 & 22.07.2023 without substantiate materials. Hence, I request this Hon'ble Court may treat this affidavit as my apology and I withdraw my complaints and allegations stated in the complaints dated 16.07.2023 & 22.07.2023.

Further, I undertake that I will not sent any complaint without substantiate materials in future as against the Hon'ble Judges and Judicial Officers...." 2.
