proceedings No. O.Mu.A5/13101/2025 and to quash the same as illegal and consequently to direct the 1st Respondent to conduct an enquiry on the appeal of the Petitioner herein dated 08.12.2025 and also to pass an order on the same within any reasonable time.

ORDER
The present writ petition has been filed seeking to quash the order passed by the first respondent herein wherein the appeal preferred by the petitioner was redirected to the second respondent.
2. The petitioner has approached the second respondent seeking legal heir certificate. The said application was rejected by the second respondent. Challenging the same, the petitioner has preferred an appeal before the first respondent. Instead of disposing the appeal, under the impugned order, the first respondent had directed the second respondent to consider the application of the writ petitioner.
3. The facts narrated above will clearly indicate that the first respondent without exercising his powers as an appellate authority, could not have redirected the petitioner to the original authority who has already rejected the 2/5
request of the petitioner.
4. In view of the above said facts, the order impugned in the writ petition is hereby set aside and the matter is remitted back to the file of the first respondent and he is directed to dispose of the appeal on merits and in accordance with law after giving due opportunity to all the interested parties. The appeal shall be disposed of within a period of 12(twelve) weeks from the date of receipt of a copy of this order.
5. With the above said observations, this writ petition stands allowed. No costs.
