The Civil Miscellaneous Petition has been filed seeking orders to condone the delay of 33 days in filing appeal, challenging the award, dated 11.09.2025 made in M.C.O.P.No.189 of 2024 on the file of the Motor Accident Claims Tribunal, Special Sub Court, to deal with MCOP cases, Tirunelveli. 2.Despite receipt of Court notice, the second respondent has not turned up.

3.Heard the learned counsel for the petitioner as well as the learned counsel for the first respondent and also perused the records.

4.The learned counsel appearing for the respondents would submit that they are having objections, but they have not specified any objections.

5.Considering the reasons assigned and also taking note of the quantum of delay, this Court is inclined to condone the delay. Accordingly, this petition is ordered and the Registry is directed to take the appeal on file, if it is otherwise in order and list the matter in the regular course.
