ORDER
Heard Mr.S.Sathyachidambaram, learned Counsel for Revision Petitioner and Mr.A.Thiruvadikumar, learned Additional Public Prosecutor for the Respondent.
2. The present Criminal Revision case has been filed challenging the order passed by the Judicial Magistrate No.IV, Trichirappalli in Crl.M.P.No. 26567 of 2025 dated 08.12.2025.
3. The learned counsel appearing for the petitioner submitted that while allowing the Petition for return of property, the Trial Court had imposed a condition to produce solvency for himself and another two sureties for a sum of Rs.43,00,000/-. He further submitted that the vehicle involved in this case is TATA Motors Tipper Lorry, bearing registration No.TN 63 BP 2257, as on date, the said vehicle is worth around Rs.20,00,000/-. Solvency directed by Trial Court is disproportionate and may be reduced. 2/4
4. The learned Government Advocate (Crl.) appearing for the respondent submitted that the order passed by the learned Trial Court is reasonable and prayed for dismissal of the Criminal Revision.
5. Keeping in view the submission made on both sides and also taking into account the value of the vehicle, this Court finds that there is some merit in the submission of petitioner and thus inclined to modify the condition No.1 to effect that the petitioner shall produce solvency for himself and another two sureties for a sum of Rs.10,00,000/- (Rupees Ten Lakhs only) each. The other conditions imposed by the learned Trial Court shall remain unaltered.
6. In view of the above, this Criminal Revision Case is disposed of. No Costs.
