ORDER

Seeking to transfer the investigation from the 2nd respondent to the 3rd respondent police in Crime No.199 of 2024, dated 08.05.2024, this criminal original petition is filed.

2. The learned counsel for the petitioner submitted that the petitioner's husband, namely Velu, was a member of Karaikudi Vallalar Sanmark Sangam. On 08.05.2024, he left house by two wheeler to attend a function conducted by the said Sangam. While he was riding his bike near Pandian Theatre, a car which came from behind, had hit her husband and left the spot without stopping the car. Subsequently, the petitioner's husband passed away at Surakudi Government Hospital. In this regard, a complaint was given and a First Information Report was registered by the 2nd respondent police for the offences under 2/6

Section 279 and 304(A) of IPC. However, there is no progress in the investigation. Hence this petition.

3. The learned Government Advocate (Crl.Side) on instructions submitted that the petitioner was not able to properly give information as to the vehicle which had involved in the accident. In this regard, the police was not able to detect the vehicle involved and hence, the F.I.R has been closed as 'undetected' and referred charge sheet has also been served upon the petitioner.

4. The learned counsel for the petitioner categorically contended that so far, she has not received any referred charge sheet.

5. Heard the learned counsel on either side and carefully perused the materials available on record.

6. It is brought to the notice of this Court that humpty number of CCTV cameras are available on the road near Pandian Theatre. The 2nd 3/6

respondent is directed to reopen the case and investigate with the aid of CCTV footages available in the locality and conclude the investigation as expeditiously as possible within a period of four (4) weeks from the date of receipt of copy of this order. It is also directed that the 2nd respondent should apprise the progress of the investigation to the 1st respondent every Friday and the 1st respondent is directed to monitor the investigation till its conclusion.

7. With the above directions, this Criminal Original Petition stands allowed.
