P RAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1, 3 and 4 to take necessary action against the 6th respondent based on the petitioner's representation dated 20.12.2022 under the Tamilnadu Maintenance and Welfare of Parents and Senior Citizen Rules 2009. ORDER

This writ petition has been filed to direct the respondents 1, 3 and 4 to take necessary action against the 6th respondent based on the petitioner's representation dated 20.12.2022 under the Tamilnadu Maintenance and Welfare of Parents and Senior Citizen Rules 2009.

2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3. When the matter is taken up for hearing, it is submitted before this Court that on the complaint lodged by the petitioner, the fourth 2/4

respondent issued summons to the petitioner. However, the petitioner failed to appear before the fourth respondent and as such, the complaint lodged by the petitioner was dismissed. However, the petitioner is at liberty to lodge a fresh complaint on fresh cause of action before the fourth respondent as against the 6th respondent. On receipt of the said complaint, the fourth respondent is directed to issue notice to the petitioner and the sixth respondent and pass orders on merits and in accordance with law, after affording an opportunity of hearing to the petitioner as well as the sixth respondent, within a period of twelve weeks thereafter.

4. With the above direction, the Writ Petition stands disposed of. There shall be no order as to costs.
