ORDER : The Court made the following order :- The petitioner/A3, who was arrested and remanded to judicial custody on 04.07.2020 for the offences punishable under Sections 294(b), 324,307, 302 and and 506(ii) of IPC on the file of the respondent police seeks bail.
2. The learned counsel for the petitioner would submit that the petitioner is arrayed as A3 in this case and he is in judicial custody for more than 226 days and investigation in this case is completed and the trial is under progress.
3. The learned Government Advocate(Crl.Side) submitted that A1 in this case has moved bail before this Court in Crl.O.P(MD) No. 13898 of 2020 and this Court by an order had directed the trial Court to complete the trial within a period of nine months. He would further submit that in this case trial commenced and PW.1 to PW 7 were examined. P.W 1 and P.W are the injured witnesses, father and son of the second deceased. PW.2 is the friend of the first deceased. P.W 4 to 7 are the eye witness to the said occurrence and they have spoken about the accused and the case stands posted for examination of other witnesses on 25.02.2021.
4. After hearing the submissions when this Court was about to dismiss the petition on merits the learned counsel for the petitioner seeks permission of this Court to withdraw the petition and he has also made an endorsement to that effect. https://hcservices.ecourts.gov.in/hcservices/
