Heard the learned counsel appearing for the petitioners and the learned Government Advocate (Crl. side) appearing for the first respondent.
2.The petitioners are facing trial in C.C.No.197 of 2021 on the file of the learned Additional Mahila Court, Tirunelveli. It is a matrimonial case.
3.The petitioners' counsel drew my attention to the order dated 23.10.2018, passed by a learned Single Judge of this Court allowing the quash petition filed by one of the accused. Though the said https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P(MD)No.1654 of 2022 contention is persuasive, I am of the view that the petitioners have to necessarily establish their innocence only before the Court below. Leaving open all their contentions and defences, this Criminal Original Petition is disposed of. However taking note of the over all facts and circumstances, the personal appearance of the petitioners before the Court below is dispensed with. Consequently, connected miscellaneous petitions are closed.
