ORDER

The petitioners/defacto complainants have filed this petition seeking to transfer the investigation on the file of the third respondent in connection with Crime No.34 of 2011 to the first respondent.

2. Heard the learned counsel for the petitioners and the learned Government Advocate (Criminal Side) for the respondents.

3. On 17.08.2015, a report has been called for from the learned Special Judicial Magistrate, Tirunelveli.

4. Today ie., on 18.08.2015, the report has been received from the learned Special Judicial Magistrate, Special Court for Land Grabbing Cases, Tirunelveli and as per the direction of this Court, the Investigating Officer is present.

5. The report reveals that referred charge sheet in Crime No.34 of 2011 has been filed on 09.07.2015. Notice was issued to the defacto complainants for appearance on 13.08.2015 and they appeared on 13.08.2015. The case was posted on 02.09.2015 for filing of the objection of the defacto complainants.

6. Recording the same, the Criminal Original Petition is disposed of. The petitioners have every right to approach the appropriate forum for challenging the referred charge sheet notice.
