ORDER

The petitioner seeks for a direction to the 3rd respondent not to interfere the civil dispute in respect of property in O.S.No. 5 of 2026 on the file of the District Munsif, Rameswaram, based on the petitioner's representation dated 12.01.2026.

2. The learned counsel for the petitioner submitted that the respondent police is illegally interfering with the civil dispute and thereby harassing the petitioner continuously. Hence, this petition came to be filed.

3. The learned Government Advocate appearing for the respondent police submitted that the petitioner and the fourth respondent are neighbours and that a dispute has arisen between them with regard to a pathway and boundary. It is further submitted that both parties have lodged complaints before the respondent police, pursuant to which CSR No.13 of 2026 and CSR No.14 of 2026 have been issued. The said complaints are presently pending 2/4

enquiry, and it is stated that the enquiry has not progressed effectively due to non-cooperation on the part of the parties concerned.

4. Heard the learned counsel on either side. Since no adverse order is proposed to be passed against the private respondents, notice to them is dispensed with.

5. Considering the facts and circumstances of the case and the nature of the dispute, which appears to be predominantly civil in character relating to pathway and boundary issues, this Court is of the view that the respondent police shall not interfere in the said civil dispute any further. The respondent police are directed to advise the respective parties to approach the competent civil forum to work out their remedies in the manner known to law.

6. With the above direction, this Criminal Original Petition stands disposed of.
