Heard the learned counsel on either side.

2.The property in question is admittedly the patta land of the writ petitioner. The official respondents were proposing to lay road across the same. It is open to the official respondents to do so, if the land in question had been acquired in the manner known to law. It is also possible, if it had been earmarked in the layout promoted by the writ petitioner or by his vendor. That is also not the case. The petitioner has not gifted the same. Looked at any from angle, there is no legal basis on which the officials respondents can propose to lay a road on the patta land of the writ petitioner.

3.Therefore, the officials respondents are restrained from laying any road on the petition mentioned land. The writ petition is allowed accordingly. I make it clear that allowing of this writ petition will not come in the way of the fifth respondent from establishing his rights in the manner known to law before the jurisdictional civil Court. No costs. Consequently, connected miscellaneous petitions are closed.
