ORDER
This Criminal Original Petition has been filed to quash the impugned charge sheet in Spl.S.C.No.108 of 2023 on the file of the Learned Sessions Judge, Special Court for Exclusive Trial of Cases under POCSO Act, Madurai.
2. This is a case where the final report has been laid as against the petitioner for having initiated a false POCSO complaint against some of the teachers, where he was serving as Headmaster. In this regard, despite having taken cognizance, the Trial Court has not come on commenced trial so far, and the petitioner has been continuously appearing before the learned trial court for the past two years.
3. Considering the nature of the offense involved, the learned Sessions Judge, Special Court for Exclusive Trial of Cases under POCSO 2/5
Act, Madurai, is directed to frame the charges forthwith and conclude the trial in S.C.No.108 of 2023 as expeditiously as possible within a period of one year from the date of receipt of a copy of this order.
4. With the above directions, this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petition is closed.
5. Considering the facts and circumstances, the personal appearance of the petitioner before the learned Trial Court is ordered to be dispensed with, on conditions that he shall appear at the time of initial questioning, proceedings under Section 313 Cr.P.C., / 351 BNSS, and at the time of passing judgment and on all the hearings, specifically directed by the learned Trial Court.
6. The petitioner shall appear before the Court in the event his presence is insisted by the learned Trial Judge for the purpose of identification. If the petitioner adopt any dilatory tactics, it is open to the learned Trial Court to insist for his appearance and deal with the 3/5
