Prayer: This Criminal Original Petition filed under Section 482 Cr.P.C., to direct the second respondent to return the petitioner's car TN 38 CS 7628 property as per the petitioners complaint dated 16.12.2021.

ORDER
This petition has been filed to direct the second respondent to return the petitioners car bearing Registration No.TN-38-CS-7628. 2.The case of the petitioner is that when he proceeded in his car towards Dindigul bearing Registration No.TN-38-CS-7628, fifteen persons stopped his car and attacked him. Thereafter, they had taken his car from there. Immediately, the petitioner lodged a complaint before the second respondent. On receipt of the same, the petitioner car was recovered from the persons, who had taken the car from the petitioner. Even then, the second respondent refused to hand over the car to him for the reason that the persons, who had taken the car, deposited huge sum to the petitioner previous company and the said amount were not returned back to them. Therefore, the second respondent insisted the petitioner to settle the amount and then only the car will be returned to him. Hence, the present petition has been filed.
3.The learned Additional Public Prosecutor would submit that the petitioner failed to produce the original documents to show that the car belongs to him, so far.

Crl.O.P.(MD)No.1802 of 2022 4.The petitioner is not an accused and no case has been registered as against the petitioner and also the car is not involved in any crime. In view of the above, the petitioner is directed to produce all the documents related to the car bearing registration No.TN-38CS-7628 to prove his ownership within a period of one week from the date of receipt of a copy of this order . On receipt of the same, the second respondent is directed to verify the documents and immediately return back the car to the petitioner. 5.With the above direction, this Criminal Original Petition is disposed of.
