ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 and 2 in Crime No.445 of 2015 on the file of the respondent police, was arrested on 17.07.2015 for the alleged offences punishable under Sections 279, 337, 304 (A), 379 I.P.C., r/w. Section 21(1) (4) (1-A) of Mines and Minerals Act and hence, seek bail.
2. The case of the prosecution is that on 17.07.2015, a tractor and trailer bearing Registration Nos.TN 50 W 7961 and TN 67 AV 3627, while transporting sand illegally, capsized and the driver Muthiya died on the spot.
3. The learned counsel for the petitioners submitted that the first accused is the owner of the tractor and the second accused is a load-man and the vehicle was driven by the deceased for which they are no way responsible. It is further submitted that the petitioners are innocent and they have been falsely implicated in this case.
4. The learned Government Advocate (Crl.side) submitted that the first petitioner is having one previous case and he is the owner of the vehicle and the second petitioner was working as a load-man at the time of occurrence.
5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioners with certain conditions. Accordingly, the petitioners is ordered to be released https://hcservices.ecourts.gov.in/hcservices/
on bail on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Srivilliputhur and on further condition that the petitioners shall report before the respondent police daily twice at 10.00 a.m. and 5.00 p.m. until further orders.
