ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.3, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 420, 465, 467, 468 and 471 of I.P.C., in Crime No.91 of 2014 on the file of the respondent police and hence, seeks anticipatory bail.

2. The prosecution case is that the petitioner, by using a fake documents, sold the property of the Municipality to the first accused.

3. This Court, on 13.02.2015, after elaborately considering the rival contentions of the parties, dismissed the application observing that the accused have conspired together and attempted to usurp the property of the Municipality somehow and therefore, they are not entitled for anticipatory bail.

4. The learned counsel for the petitioner submitted that the petitioner is senior citizen of 79 years old and he is ready to co-operate for investigation and he is also ready to produce all the documents before the investigating officer.

5. The learned Government Advocate (Crl.side) submitted that the earlier application was dismissed holding that he is not entitled for anticipatory bail.

Considering the gravity of the offences, this application cannot be considered again as rightly contended by the learned Government Advocate (Crl.side), I do not find any justification to grant anticipatory bail to the petitioner now.
