ORDER : The Court Made the following order :- The petitioner is arrayed as Sole Accused in Crime No.95 of 2015 on the file of the respondent police, for the offence punishable under Sections 294(b) and 307 I.P.C. altered to 294(b) and 302 IPC. The petitioner was arrested and remanded to judicial custody on 09.06.2015. He has come forward with this petition seeking bail. 2.The case of the prosecution is that the deceased is the wife of the accused. They are having three child and they were residing in the State of Karnataka and they came to their native place recently and as the deceased was suffering from some illness, she wanted to go to witch hunter, for which she insisted the accused to pay Rs.7,500/-. However, the accused was insisting the wife to go to Karnataka and in the quarrel, the accused has poured kerosene and set fire. 3.

The learned counsel for the petitioner submitted that the deceased herself committed self-immolation and the petitioner has been falsely implicated in this case. It is further submitted that the petitioner has been incarceration for more than 64 days and he is having three school going children and nobody is there to take care of them. 4.The learned Government Advocate (Criminal Side) would submit that the occurrence had taken place on 08.06.2015 and the major part of the investigation is over.

5.Considering the submission of the learned counsel for the petitioners and the learned Government Advocate (Criminal Side), this court is inclined to grant bail to the petitioner.

6. Accordingly, the petitioner is directed to be released on bail, on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction https://hcservices.ecourts.gov.in/hcservices/

of the learned Judicial Magistrate, Srivaikundam, Thoothukudi District and on further condition that the petitioner shall report before the respondent police daily twice at 10.00 a.m. and 05.00 p.m until further orders.
