ORDER

The present writ petition has been filed by the wife of the former Corporation employee seeking a mandamus directing the respondents 1 and 2 to provide house allotment in Subramaniyapuram Harijan Colony, Madurai.

According to the learned Counsel appearing for the writ petitioner, the petitioner's husband was working in the Madurai Corporation for a period of 40 years and he had retired in 2010 and passed away in the year 2018 and thereafter, the petitioner has put up a hut in block No.L4 and she is residing there.

3. According to the learned Counsel appearing for the writ petitioner, she is not having any other house in the locality and she had approached the Corporation for inclusion of her name for allotment of the house. However, her application was not accepted.

The learned Counsel appearing for the writ petitioner further submits that on 10.01.2022, an application has been made to the first respondent and on 13.01.2022 application has been made to the second respondent. However, so far orders have not been passed. He further submits that another application was made to the District Collector, Madurai, on 23.06.2025. However, so far allotment orders have not been passed.

5. The learned Counsel appearing for the second respondent submitted that a beneficiary list consisting of 259 names was forwarded to the first respondent on 26.02.2021. In the said list, the petitioner's name was not included and therefore, the allotment was not made by the first respondent.

The learned Counsel appearing for the first respondent submitted that the allotment of all the 259 plots have been completed and therefore, as on today, there is no available plot to be allotted to the writ petitioner. He further submits that 160 houses have been constructed by the first respondent which are yet to be allotted. In case if the petitioner makes an application to the District Collector and the same is forwarded, they would consider the same. 3/6

7. Considering the above said facts, the District Collector, Madurai, is suo motu impleaded as the third respondent. The third respondent is directed to forward the application received by him on 23.06.2025 to the first respondent within a period of 3(three) weeks from the date of receipt of a copy of this order. On receipt of the same, the first respondent is directed to consider the said application on its merits and pass orders within a period of 8(eight) weeks thereafter.

8. With the above said observations, this writ petition stands disposed of. No costs.
