Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is the sole accused, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 506(i) and 498 of I.P.C., in Crime No.10 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2. The prosecution case is that the accused had married the wife of the de-facto complainant viz., Samaya Rani, while the earlier marriage was subsisting and also threatened the de-facto complainant in the presence of All Women Police Station, Virudhunagar.

3. The learned counsel for the petitioner submitted that the wife of the de-facto complainant and the petitioner fell in love with each other and long back the marriage was also performed and thereafter, she was forced to marry the de-facto complainant on 31.08.2014 against her wish. It is further submitted that the wife of the de-facto complainant is 24 years old and the petitioner has been implicated with an ulterior motive.

5. Heard the learned Government Advocate (Crl.side).

6. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be https://hcservices.ecourts.gov.in/hcservices/

released on bail in the event of his arrest or on his appearance before the learned Judicial Magistrate, Arupukottai and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall reside at Coimbatore and report before the Peelamedu Police Station daily at 10.00 a.m. for a period of two weeks and thereafter as and when required. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
