ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) Challenging the order passed by the learned Single Judge in W.P.(MD)No.21267 of 2025, the present writ appeal is filed. 2.Heard the learned counsel appearing on either side and perused the materials placed on record.

3.The writ petition has been filed challenging the order of the District Collector dated 03.12.2024 relieving the appellant/writ petitioner from the the post as Assistant in the Panchayat Union. 4.According to the appellant, since there was quarrel in his office, the disciplinary proceedings was initiated against him and he was placed under suspension. Later the suspension was revoked in the year 2023. Thereafter, he was imposed with the punishment of stoppage of 2/5

increment for three years with cumulative effect. Challenging the same, the appeal filed by the appellant before the first respondent is pending for consideration. Thereafter, his suspension was revoked and he was placed in Virudhunagar District. While so, the appellant was again tranferred to Sivagangai District. Challenging the same, the petitioner has filed the writ petition. The learned Single Judge after taking note of the fact that already the punishment has been imposed for the disciplinary proceedings initiated against the appellant and the present transfer order to Sivagangai District cannot be permitted, dismissed the writ petition directing the appellant to make representation before the first respondent. Being aggrieved by the said order, the petitioner has filed the present writ appeal.

5.The learned counsel for the appellant would submit that the order of transfer to Sivagangai District was not made on administrative exigency, but is punitive in nature.

6.The learned Additional Government Pleader appearing on behalf of the official respondents, on instructions, submitted that during the pendency of this writ appeal, the order transferring the petitioner to 3/5

Sivagangai District has already been revoked by the proceedings dated 25.02.2026 and now the appellant has given transfer to some other department in the same District.

7.In view of the above, nothing survives for adjudication in this writ appeal. Accordingly, the writ appeal is dismissed. Consequently, connected miscellaneous petitions are closed. There shall be no order as to costs.
