Prayer in CRL RC(MD). 28/ 2022 :

To set aside the order passed in Crl.MP.No.91 of 2018 in Mc.No.27 of 2008 dt.5.10.2021 filed by the Respondent on the file of the Learned Family Court, Nagercoil.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.MOHAN GANDHI.S.M., Advocate for the petitioner and of MR.S.XAVIER RAJINI, ADVOCATE on behalf of the Respondent, the court made the following order:- This petition is filed to modify the order passed in Crl.M.P (MD)No.556 of 2022 in Crl.R.C(MD).No.28 of 2022, dated 19.01.2022. 2.The learned counsel appearing for the petitioner would submit that this Court, by order dated 19.01.2022 while suspending the sentence directed the petitioner to deposit entire arrears amount before the trial Court.

He would further submit that the petitioner working as a Coolie in the brick chamber and also due to pandemic situation of COVID-19 he lost his job and he could not mobilize the entire arrears amount and hence, he seeks modification of the order. 3.In view of the submission made by the learned counsel for the petitioner, the condition imposed by this Court, dated 19.01.2022 is modified to the effect that the petitioner shall deposit a sum of Rs.2,00,000/- (Rupees Two Lakhs only) to the credit of M.C.No.27 of https://hcservices.ecourts.gov.
