O R D E R

This petition has been filed praying to direct the second respondent to register a criminal case against the accused based on the complaint dated 13.07.2015 by the petitioner and to take action against the accused in accordance with law.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.side) appearing for the State. 3.The learned counsel for the petitioner would submit that the petitioner has given a complaint on 13.07.2015, but, the respondent has not registered a case. Hence, the petitioner has come forward with this application for a direction directing the second respondent to register a case on the basis of the complaint given by the petitioner on 13.07.2015.

4. The learned Government Advocate (Crl.side) would submit the second respondent has received the complaint of the petitioner dated 13.07.2015 and the same is pending in C.S.R.No.245 of 2015.

5. As per the judgment of the Hon'ble Supreme Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)], the second respondent shall conduct preliminary enquiry and register a case if any cognizable offence is made out.

6. With the above directions, this Criminal Original Petition is disposed of.
