For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.25 of 2022 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 9(B)(1) (b) of the Indian Explosive Act, 1884 and Section 4(b) of Explosive Substance Act, 1908 in Crime No.25 of 2022 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that on 18.01.2022 at about 09.42 am., the respondent police was in routine rounds and they found that the accused persons were loading with home made explosive in the bag. Hence, the complaint.
3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution.
4.The learned Government Advocate (Crl. side) would submit that the petitioner is the suspended police man and he was implicated on the basis of the confession statement given by the second accused and that the investigation is not yet completed. https://hcservices.ecourts.gov.in/hcservices/ 1/2

No.1387 of 2022 5.Considering the seriousness and gravity of the offence alleged and also the facts that the petitioner is having some previous cases and that the investigation is not yet completed as stated by the learned Government Advocate (Crl. side), this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 21/02/2022 / TRUE COPY / / /2022 Sub-Assistant Registrar (C.S.)
