ORDER : The Court Made the following order :- The petitioner, who is arrayed as A3 in Crime No.571 of 2012 on the file of the respondent police, was arrested and remanded to judicial custody on 05.07.2015 in pursuance of non bailable warrant issued in P.R.C.No.12 of 2013 by the learned Judicial Magistrate No.2, Tuticorin for the alleged offences punishable under Sections 302, 324, 294(b) and 506(ii) of I.P.C., and hence, seeks bail.

2.The learned counsel for the petitioner submitted that this petitioner/A3 was regularly appearing before the committal Court, but on 28.05.2015 due to illness he could not appear before the committal Court and hence, non bailable warrant was issued against the petitioner. He further submitted that the petitioner undertakes to appear before the committal Court as well as the trial Court for all hearing dates, without fail.

3.Heard the learned Government Advocate (Crl.side) appearing for the State who would submit that the petitioner is having four previous cases and he was appearing before the trial Court and he was absent only on 28.05.2015.

4.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.2, Tuticorin, and on further condition the the petitioner shall appear before the committal Court as well as the trial Court for all hearing dates, without fail.
