ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 353 and 379 of IPC and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.384 of 2020, seeks anticipatory bail.

2.The case of the prosecution is that on 10.12.2020 at about 09.20 p.m., the petitioner along with other accused were found in illegal possession of two units of river sand. Hence, the complaint.

3.The learned counsel for the petitioner submitted that the petitioner is innocent and he has not involved in this case and he has been falsely implicated in this case and even after a lapse of four months, no arrest has been made.

4.According to the learned Government Advocate (Criminal side), the petitioner taking advantage of his position has threatened the police officials and got the vehicle released. https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.3826 of 2021 5.Taking note of the serious allegation made against the petitioner and also the petitioner's earlier applications were dismissed, there is no change in circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. 6.In the result, this petition is dismissed.
