PRAYER :- For Bail in Crime No. 1015 of 2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Accused, who was arrested and remanded to judicial custody on 14.12.2022 for the offence under Sections 451, 342, 392 and 397 IPC in Crime No.1015 of 2022, seeks bail. 2.The case of the prosecution, as per the de-facto complainant is that she is residing at door No.25, Sundar Nagar 7 th Cross Street, K.K.Nagar, Trichy and that on 18.10.2022, the person aged about 45 years claiming himself to be one Rajesh, had come to her house in the guise of taking the upstairs portion for rent and she had allowed him inside and the accused, after coming into the house, had threatened her with a knife and had robbed six sovereigns of gold chain and two bangles from her and pushed her into the room and locked the room and escaped from the scene of occurrence. Hence, the case came to be registered.

CRL OP(MD). No.2301 of 2023 3.The learned counsel for the petitioner would submit that the petitioner is an innocent and a false complaint has been registered against him. This is the third petition for bail and prays for bail.

4.The learned Additional Public Prosecutor would submit that though this is the third petition for bail, the petitioner is a habitual offender and in this case, investigation with regard to Finger Print is pending. Hence, seeks for dismissal. 5.Heard. Perused the materials available on record including the FIR.

6.Taking into consideration of the nature and gravity of the offence and considering the vehement objection made by the learned Additional Public Prosecutor that the petitioner is a habitual offender and considering the stage of pending investigation, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed for the present.
