O R D E R
(Order of the Court was made by G.K.ILANTHIRAIYAN, J.) This Habeus Corpus Petition has been filed to direct the second respondent to produce the body or person of the petitioner's husband namely Ravivarman son of Avvaiyar aged about 25 years before this Court and hand over custody to the petitioner.
2. The petitioner is the wife of the detenu. They got married and gave birth to two children. While being so, on 23.07.2025 the husband of the petitioner went for job but he did not return home, therefore she lodged a complaint before the second respondent and the second respondent registered a case in Crime No. 58 of 2025 under 'Man Missing'. During investigation the second respondent found that the husband of the petitioner Ravivarman eloped with another woman namely Hema who had obtained divorce. Further the brother of the said Hema namely Manikkaraj also lodged a complaint before the Inspector of Police, Anna Nagar Police Station, Madurai City and the
same has been registered in Crime No.543 of 2025 under 'Woman Missing'. The husband of the petitioner and the said Hema eloped and their whereabouts are not known .
3. Admittedly the detenue is major and he is not under illegal detention of any one.
4. In view of the same, the Habeus Corpus Petition stands dismissed as not maintainable. However the second respondent is directed to complete the investigation and file final report in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order [G.K.I., J.] [R.P., J.] 22.01.2026 NCC: Yes/No Index: Yes/No aav
