ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Section 420 of I.P.C., and Section 138 of Negotiable Instrument Act, in Crime No.Not Known of 2021 on the file of the respondent police, seeks anticipatory bail.

3. It is stated that the respondent police is yet to receive the case bundle.

4.Be that as it may, the facts remain that no FIR has been registered against the petitioner. It is admitted that petition enquiry is pending. If at the end of enquiry, the respondent registers any FIR against the petitioner, the petitioner will be put https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.1407 of 2021 on notice, so that, the petitioner will have breathing time to move the concerned Court for the relief of anticipatory bail. There is no question of orally summoning the petitioner to the police station for enquiry. If the respondent wants to enquire the petitioner, only written summons will be issued.

5.With this direction to the respondent, this Criminal Original Petition is disposed of.
