ORDER

The petitioner was working as a Special Tahsildar and he was allowed to retire on attaining superannuation on 31.05.2025. Seven months after his date of retirement, the first respondent has passed the order impugned as if the pay of this petitioner has been erroneously fixed from the year 2006 to 2025 and ordered recovery of a sum of Rs.3,33,560/-.

2.The contention of the petitioner is that the order impugned in this writ petition has been passed without providing any opportunity to the petitioner.

3.The learned Additional Government Pleader appearing for the respondents fairly concedes that no opportunity of hearing has been given to the petitioner.

4.This Court has considered the submissions made on either side and perused the available materials in the record. 2/4

5.Admittedly, this impugned order has been passed without providing an opportunity to the petitioner and therefore, on this limited ground, the order impugned in this writ petition dated 30.12.2025 is set aside and the matter is remitted back to the first respondent to provide an opportunity to the petitioner by issuing a show cause notice and thereafter, the first respondent shall pass a reasoned order. Accordingly, this writ petition is allowed. No costs.
