ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Section 294(b), 324, 506(ii) of IPC r/w Section 4 of Women Harassment Act, in Cr.No.17 of 2019 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complainant is the lover of the petitioner and due to some bad antecedents, she is not willing to joint with the petitioner. Thereafter, since the defacto complainant refused to joint with the petitioner, she was assaulted by the petitioner, thereby she sustained grievious injuries. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he did not commit any offence as alleged by the prosecution. Due to a small dispute arose between the petitioner and the defacto complainant, she had lodged the false complaint against him.

4.The learned Government Advocate (Crl.Side) appearing for the State would submit that due to bad antecedents, the defacto complainant refused to joint with the petitioner. Though she has https://hcservices.ecourts.gov.in/hcservices/

been discharged from the hospital, the petitioner again attacked the defacto complainant and vehemently opposed for granting of anticipatory bail to the petitioner.

5.Considering the facts and circumstances of this case and since the petitioner is having bad antecedents and the injury was grievious in nature, this Court is not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this criminal original petition stands dismissed.
