ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 08.10.2025 for the offences punishable under Sections 376, 294(b), 506(2) of IPC r/w. Section 6 of the Protection of Children from Sexual Offences Act, 2012 altered into Sections 294(b), 109, 506(2) of IPC r/w. Section 6, 5(1), 5(j)(ii) of Protection of Children from Sexual Offences Act, 2012, in Spl S.C.No.72 of 2018 on the file of the Learned Sessions Judge, Principal Special Court for Exclusive Trial of Cases under POCSO Act, Madurai., seeks bail.

The case of the prosecution is that the marriage between the defacto complainant and the first accused was solemnized at Oorkalan Koil, Sithalankudi, in the presence of Accused Nos.4 and 5, along with the petitioner and Accused No.7, one minor, Narayanan. Thereafter, the defacto complainant conceived. Subsequently, the first accused did not visit her, and his mobile phone was switched off. When she went to his house to meet him, Accused Nos.1 to 5 allegedly abused her in filthy language, stated that they were arranging his marriage elsewhere with 2/5

dowry, and intimidated her with dire consequences. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is in judicial custody from 08.10.2025. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that this is the second bail application. This Court had dismissed the earlier bail application and directed the concerned trial Court to completed the trial within a period of three months.

5. Since the said period of three months has not completed, the present petition cannot be entertained. Considering the same, this Court is not inclined to grant bail to the petitioner. 3/5
