ORDER : The Court Made the following order :- The petitioner, who is arrayed as the sole accused in Crime No.151 of 2015 on the file of the respondent police, was arrested and remanded to judicial custody on 19.06.2015 for the alleged offences punishable under Section 302 of I.P.C., and hence, seeks bail.
2.According to the prosecution, on 17.06.2015 the accused had gone to the house of the deceased to see a new born child of the accused and also demanded additional dowry from his mother-in-law and in the scuffle, the accused attacked her with knife and caused her death.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case and that on 17.06.2015, there was a family dispute, the father-in-law of the accused attempted to stab the petitioner with knife and in the scuffle, the deceased intervened and sustained injury and died.
4.The learned Government Advocate (Crl.side) would submit that in a sudden provocation, the accused attacked his own mother-in-law with knife and killed her on 17.06.2015.
5.Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail on condition that the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned https://hcservices.ecourts.gov.in/hcservices/
Judicial Magistrate, Thiruvadanai and on further condition that the petitioner shall reside at Viruthachalam and report before Viruthachalam Taluk Police Station daily twice ie., at 10.00 a.m., and 05.00 p.m., until further orders.
