ORDER

(Order of the Court was made by the Hon'ble A.D.JAGADISH CHANDIRA J.) This petition has been filed to permit the petitionres/Respondents 1 to 3 to withdraw the amount deposited by the first respondent/Appellant on the file of the M.C.O.P.No.116/2020, the Motor Accident Claims Tribunal/Chief Judicial Magistrate, Kanyakumari at Nagercoil.

2. Mrs.K.R.Shivasakari, learned counsel appearing for the Insurance Company would vehemently opposed stating that the appellants are denying the negligence and the quantum.

3. The learned counsel for the petitioner/claimants would submit that the MCOP is of the year 2019 and the award has been passed in the year 2020 and that the claimants are suffering without payment.

4. In view of the above, the petitioners/Respondents 1 to 3 are permitted to withdraw 50% of the deposited amount with proportionate accrued interest and costs by filing proper petition before the Tribunal. 2/3

5. Post the matter after four weeks.
