Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Section 229 A of IPC, in Cr.No.140 of 2018 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that a case is pending against the petitioner in S.T.C.No.307 of 2017 on the file of Judicial Magistrate, Manapparai. Since he did not appear before the Court, non bailable warrant was issued. Thereafter, the petitioner surrendered before the Court with recall warrant petition. Thereafter, the petitioner not co-operated to complete the trial. Hence, the complaint was lodged by the learned Judicial Magistrate, Manapparai.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he did not commit any offence as alleged by the prosecution. The petitioner was already granted anticipatory bail by this Court in Crl.O.P.(MD).No.12127 of 2018 on 17.07.2018, thereafter he was unable to execute the sureties. Hence, the petitioner has come forward with this petition.

4.The learned Government Advocate (Crl.Side) appearing for the State would submit that the petitioner was already granted anticipatory bail in Crl.O.P.(MD).No.12127 of 2018 on 17.07.2018, thereafter, extension of time also granted to the petitioner in Crl.M.P.(MD).No.6919 of 2018 dated 03.09.2018. 5.Considering the facts and circumstances of this case, the petitioner is directed to comply with the order passed in Crl.O.P. (MD).No.12127 of 2018 on 17.07.2018.

6.Accordingly, this criminal original petition is disposed of. sd/- 11/02/2019 / TRUE COPY / Sub-Assistant Registrar (C.S.) Madurai Bench of Madras High Court, Madurai - 625 023.
