PRAYER :- For Bail in Crime No.2 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/First Accused, who were arrested on 06.01.2022 for the alleged offence under Sections 379 of IPC r/w Section 21(1) of Mines & Minerals (Development & Regulation) Act, 1957, in Crime No.2 of 2022 on the file of the respondent police, seeks bail. 2.The prosecution case is that the petitioner has illegally transported 1 unit of river sand by using a Bullock carts. Hence, the complaint.
3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He would further submit that the petitioner is in judicial custody from 06.01.2022.
4.The learned Government Advocate(Crl.side) appearing for the respondent police submitted that the one previous case is pending against the petitioner.

5.Considering the facts and circumstances of this case and considering the duration of custody, this Court is inclined to grant bail to the petitioner with certain conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate Alangudi, Pudukkottai, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders. 7.The petitioner shall file an undertaking affidavit before the concerned Police station stating that he will not indulge in any such sort of illegal activities in future. If there is any violation of affidavit or if any fresh case is registered against him, the bail granted by this Court shall stand cancelled automatically without any reference to the Court.
