For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :-For Anticipatory Bail in Crime No.511 of 2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 354-A, 420, 506(i) I.P.C., and Section 4 of TNPHW Act, in Cr.No.511 of 2021, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant approached the petitioner, who is working as a Deputy Inspector of Surveyor, for mutation of patta for her properties and the petitioner demanded Rs.1,00,000/- for issuance of patta and that the complainant had paid the same, however, the petitioner has not issued any patta. Hence, the present complaint.
3. The learned Counsel for the petitioner would submit that though the incident was allegedly occurred on 27.09.2021, the F.I.R. came to be registered on 31.12.2021 and the petitioner has nothing to do with the alleged occurrence and that he was falsely implicated in this case.

The learned Additional Public Prosecutor appearing for the State would submit that the petitioner is working as a Deputy Inspector of Surveyor and when the complainant had approached him for mutation of patta for her properties, he came to the house of the defacto complainant and he misbehaved with her and also demanded a sum of Rs.1,00,000/- for issuance of patta and that the complainant had paid Rs.1,00,000/- as per the demand made by the petitioner and thereafter, the petitioner has not issued any patta as agreed by him.
5. Considering the nature and seriousness of the offences allegedly committed by the petitioner and also the fact that the investigation is at the initial stage as stated by the learned Additional Public Prosecutor appearing for the State, this Court is not inclined to grant anticipatory bail to the petitioner at this point of time.
