The above petitions have been filed (i) to set aside the abatement caused due to the death of the third respondent and (ii) to bring on record the proposed fourth respondent as legal heir of the deceased third respondent and rank her as fourth respondent in the above second appeal.

2. No representation for the fourth respondent.

3. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the first respondent.

4. The petitioner filed a petition in CMP(MD)No.926 of 2024 to condone the delay of 542 days in filing the petition for setting aside the abatement caused due to the death of the third respondent and the said petition is allowed today.

5. Considering the above, these petitions are ordered and the Registry is directed to carry out necessary amendment in the main papers.
